Claims come from the work itself
An agency's biggest risks aren't slip-and-falls. They're a client saying a campaign missed its launch or wasted its budget, a photo or song used without a license, a competitor claiming an ad disparaged them, or a customer list mishandled in an email blast.
Professional liability can cover mistakes in the services you deliver, and media liability addresses copyright, trademark, defamation and privacy claims over content you create. I pair the two with cyber and a business owner's policy for the office.
- Professional liabilityMissed deadlines, errors and failed campaigns.
- Media liabilityCopyright, trademark and defamation claims.
- Cyber liabilityClient data and email list breaches.
- Business owner's policyOffice, laptops and general liability.
What underwriters will ask
Having these ready means I can go to market on the first call. The quote form asks for the same things, and anything you don’t know yet can wait.
- Agency: name, address and years in business.
- Services: creative, media buying, PR, digital or direct mail.
- Clients: largest accounts and the industries you serve.
- Contracts: insurance and indemnity terms clients ask for.
- Revenue and staff: annual revenue, employees and freelancers.
- History: current policies and any client disputes.
Marketing agency insurance, answered
Does general liability cover a copyright claim over an ad?
Its advertising injury part is narrow, and standard forms exclude businesses whose work is advertising or media. Agencies usually need media liability for that, subject to the policy terms.
A client says my campaign cost them sales. Is that covered?
That's a professional liability claim. The policy can pay defense and settlements for alleged errors in your services, subject to its terms.
Do I need cyber insurance if clients host their own data?
Often yes. Agencies hold logins, ad accounts and customer lists, and a breach on your side can still lead to claims.
Do I need workers' comp for freelancers?
California applies a strict test to who counts as an employee. If a freelancer is an employee under that test, you need workers' comp for them.
Do you offer marketing agency insurance outside California?
Yes. Clients across the country send the same quote form. Sam Alishahi is licensed in 48 states and Washington, DC and places policies there directly. In Florida and Washington, where Sam's licenses are still being issued, a partner agency in your state helps in the meantime. The shopping across carriers works the same way. Rules, minimums and markets differ by state — see insurance requirements by state.
