How it works

Hands-on services need two kinds of liability

A day spa is judged on its services menu. Facials, waxing, peels, body wraps, massage, saunas and cold plunges each carry a professional liability exposure, which is a different policy part from the slip in the locker room that general liability handles. I go through the menu line by line, because a treatment the insurer never saw on the application is the one that gets excluded when a burn, a reaction or a pulled muscle turns into a claim.

Licensing shapes the quote. In California, estheticians hold a license from the Board of Barbering and Cosmetology, and the Board lists lasers of any kind, intense pulsed light, injections and microneedling as outside their scope. Massage therapists can hold voluntary CAMTC certification, which many cities and counties now require in place of a local permit. Lasers and injectables belong on my med spa page, where physician supervision is part of the application.

Staffing matters too. Employees need workers' comp, while booth renters and independent contractors should carry their own professional liability and name the spa as an additional insured. Retail skincare and supplements add product liability, infrared saunas raise equipment and fire questions, and IV drips are usually excluded unless a medical professional and a medical policy are involved. Abuse and molestation coverage protects the business when a client alleges misconduct in a private room.

  • Professional liabilityTreatment injuries and reactions from esthetics and massage, subject to the policy.
  • General liabilitySlips, falls and burns on the premises.
  • Property and incomeTreatment tables, steam rooms, stock and lost revenue after a covered loss.
  • Abuse and molestationAllegations against staff in treatment rooms.

Questions

Day spa insurance, answered

Can my esthetician do laser hair removal if a doctor supervises?

No. The Board of Barbering and Cosmetology lists lasers of any kind and intense pulsed light as outside an esthetician's scope, and a February 28, 2013 Board bulletin states that any licensee who uses a laser in the treatment of a person is guilty of a misdemeanor. Laser and injectable services need a medical structure; see my med spa page.

Does massage need a state license in California?

CAMTC certification is voluntary at the state level, but many cities and counties require it, and a city cannot require a CAMTC-certified therapist to get an additional local permit to practice. Massage businesses themselves are still regulated locally. Insurers ask for the certificates either way.

Are my contractors covered under the spa's policy?

Usually not for their own work. Contractors and booth renters should carry their own professional liability and list the spa as an additional insured; the spa's policy covers the premises and the spa's own employees, subject to the terms.

Is IV therapy or a cold plunge covered?

A cold plunge or sauna is a premises question I disclose up front. IV therapy is a medical service that most spa policies exclude; it needs a licensed provider and a medical professional policy.

Why do insurers ask about abuse and molestation coverage?

Private rooms and physical contact create that exposure. The coverage responds to allegations of misconduct by staff, and insurers want hiring, chaperone and complaint procedures written down.

Do you offer day spa insurance outside California?

Yes. Clients across the country send the same quote form. Sam Alishahi is licensed in 49 states and Washington, DC and places policies there directly. In Florida, where Sam's licenses are still being issued, a partner agency in your state helps in the meantime. The shopping across carriers works the same way. Rules, minimums and markets differ by state — see insurance requirements by state.
