Same protection, different rules
Your auto policy doesn’t pay for a car that breaks down. The California Department of Insurance says comprehensive coverage does not cover mechanical breakdown, normal wear and tear or maintenance. Repair coverage comes in three forms: a vehicle service contract from a service contract provider, a service contract where the dealer is the obligor, and mechanical breakdown insurance. The first two are what dealers usually call an extended warranty. MBI is an insurance policy, so the insurance company is the one that owes you.
That difference matters. In California, the Department of Insurance regulates the price of MBI so it isn’t excessive, and MBI can only be sold by licensed insurance companies and agents; the price of a service contract isn’t regulated and can be negotiated like the car. Which cars qualify for MBI is up to each insurance company, and it’s commonly limited to newer cars with low mileage, so the time to ask is soon after you buy. What’s the difference between MBI and an extended warranty?
Protection can look the same; the rules differ. New York’s insurance regulator has described mechanical breakdown coverage as essentially the same kind of protection as a service contract, regulated as insurance instead. In California, MBI prices are regulated by the Department of Insurance and service contract prices are not.
Which cars qualify for MBI?
Each insurance company sets its own eligibility, commonly based on the car’s age and mileage, and many only write it on newer cars. Ask soon after you buy. Price also depends on the miles on the odometer when coverage starts.
What does MBI usually exclude?
Read the exclusions section. Repair agreements often won’t pay for breakdowns caused by skipped maintenance, overheating, wrong or contaminated fluids, alterations, towing too much weight, pre-existing damage, or negligence. Some exclude wear and tear, and commercial use is often excluded unless you bought that coverage.
Does MBI pay while my factory warranty is still in effect?
No. The California Department of Insurance notes that a breakdown covered by a manufacturer’s new car warranty won’t be covered by a service contract or MBI. Compare the dates before you buy, so you aren’t paying for overlap.
What records do I need to keep?
Proof of routine maintenance. A claim can be denied if you can’t show a part that needed maintenance was maintained, and the FTC notes that skipping the manufacturer’s schedule might void a service contract. Keep receipts and a log with dates and mileage.
