Tanks, canopies and the store inside
A gas station is really three or four businesses on one lot: a fuel retailer, a convenience store, sometimes a car wash, sometimes a repair bay. Each one brings its own exposure. A customer slips on a wet forecourt, a delivery truck clips the canopy, a tank monitor flags a release, a clerk is robbed at night, or beer is sold to someone who later causes a crash. I look at every piece before I quote any of it.
The piece that trips up most owners is the tank. Federal rules at 40 CFR Part 280 require underground storage tank owners and operators to show financial responsibility for releases, and petroleum marketing facilities carry the higher per-occurrence tier. California's State Water Resources Control Board runs the UST program, with local certified unified program agencies handling leak prevention on the ground, and the state's UST Cleanup Fund is one accepted way to meet the requirement. A tank pollution policy is the other. Neither is part of a plain general liability form.
Fuel stations in California also sit under the Air Resources Board's vapor recovery program, which certifies the equipment that captures gasoline vapor during deliveries and fill-ups. If you sell beer and wine, the off-sale license from Alcoholic Beverage Control brings liquor liability into the picture. I ask about all of it, then shop the station to markets that write fuel retail, which often means surplus lines for the tank and the liquor pieces.
- Underground storage tank liabilityThird-party claims and corrective action after a release, subject to the policy.
- PropertyCanopy, dispensers, tanks, car wash equipment and store inventory.
- Liquor liabilityBeer and wine sold for consumption off the premises.
- GaragekeepersCustomer vehicles in your care if you run a service bay.
What underwriters will ask
Having these ready means I can go to market on the first call. The quote form asks for the same things, and anything you don’t know yet can wait.
- Location: address, hours and whether the station is open overnight.
- Tanks: number, age, construction and the last monitoring results.
- Sales mix: fuel gallons, store sales, car wash and repair income.
- Alcohol: ABC license type and the share of beer and wine sales.
- Vehicles: any owned delivery or service trucks and who drives them.
- History: current policies, loss runs and any past tank releases.
Gas station insurance, answered
Does general liability cover a leaking tank?
Usually not. Standard liability forms carry a pollution exclusion, so a release from an underground tank needs its own tank pollution policy or another accepted financial responsibility mechanism.
How much tank coverage does the law require?
Federal rules set a per-occurrence amount of one million dollars for petroleum marketing facilities, with an annual aggregate that depends on how many tanks you own. California's certification form tracks the same tiers. I match the policy to the form you file with your local agency.
Can the UST Cleanup Fund replace a tank policy?
The State Water Resources Control Board describes the Fund as one way for eligible petroleum tank owners and operators to meet financial responsibility. Eligibility has conditions, and many owners still carry a tank policy for the claims the Fund does not pay. I walk through both.
Do I need liquor liability for beer and wine?
If you hold a Type 20 or Type 21 off-sale license, yes. Claims after a sale to a minor or an intoxicated customer fall outside general liability, and the liquor policy responds subject to its terms.
Is a repair bay covered under the station policy?
Only when the policy includes garage liability and garagekeepers. Without them, damage to a customer's car while it is on your lift is not covered.
Do you offer gas station insurance outside California?
Yes. Clients across the country send the same quote form. Sam Alishahi is licensed in 49 states and Washington, DC and places policies there directly. In Florida, where Sam's licenses are still being issued, a partner agency in your state helps in the meantime. The shopping across carriers works the same way.
