Short answer: Your Alaska landlord's policy doesn't cover your belongings. Under AS 34.03.070, prepaid rent plus deposit generally can't exceed two months' rent, though that cap doesn't apply where rent is over $2,000 a month. If proper notice was given, the landlord must mail the refund and itemized notice within 14 days after the tenancy ends and you deliver possession. The deadline is 30 days if damage costs are deducted or if proper notice wasn't given. Willful noncompliance can cost the landlord up to twice the amount withheld.
This guide is general information for Alaska renters. It isn't legal advice, and local ordinances can add rules. Your lease and policy wording control.
Your landlord's policy covers the building, not your belongings or liability. A renters policy (HO-4) covers personal property, personal liability and loss of use; flood is generally excluded (see FloodSmart). Coverage basics: renters insurance. Roommates: whether renters insurance covers roommates. Liability: how much renters liability coverage you need.
Step 1: Deposit cap and trust account
Under AS 34.03.070, prepaid rent and deposit combined can't exceed two months' periodic rent, except where rent exceeds $2,000 a month. Deposits must be promptly placed, wherever practicable, in a trust account and accounted for separately for each tenant.
Step 2: Refund deadlines
- If you or the landlord gave notice that complies with AS 34.03.290, the written notice and refund are due within 14 days after the tenancy ends and you deliver possession.
- If the landlord deducts for damage, the deadline is 30 days.
- Without compliant notice, the deadline is 30 days after termination, delivery of possession, or the landlord learning the unit was abandoned.
Damages don't include normal wear and tear.
Step 3: Penalty
If the landlord willfully fails to comply, you may recover up to twice the amount withheld.
Step 4: Earthquake and winter
Standard renters policies typically exclude earthquake and flood, but cover fire and burst pipes. Ask about earthquake coverage for your belongings, and see FloodSmart for flood.
