Short answer: Under Colorado's HB25-1182, admitted insurers and the Colorado FAIR Plan that use wildfire risk models must consider verified property and community mitigation, or else offer mitigation discounts. They must give you your wildfire risk score with renewal or nonrenewal notices, and they must acknowledge an appeal within 10 calendar days and decide it within 30.
What the law requires
HB25-1182, which adds C.R.S. §10-4-124, applies to admitted insurers and the Colorado FAIR Plan. The Colorado Division of Insurance summarized it in a consumer bulletin as the new protections took effect:
- Mitigation must count. An insurer that uses a wildfire risk model to price, underwrite, surcharge or nonrenew must take verified property-level and community-level mitigation into account, or offer discounts for demonstrated mitigation.
- You get your score. Policyholders receive their wildfire risk score or classification with the renewal offer or, if the policy isn't renewed, with the nonrenewal notice. Applicants get it within 15 days of a completed application.
- You can appeal. Insurers must acknowledge a mitigation-related appeal of the score within 10 calendar days and decide it within 30.
The Division's Bulletin B-5.56 gives insurers guidance on the annual written notice about risk scores and mitigation discounts.
How to use these rights
- Find your score on your renewal paperwork or nonrenewal notice.
- Document mitigation: defensible space, ember-resistant vents, a Class A roof, cleared gutters, and any community programs, with photos, invoices or inspection reports.
- Ask how mitigation is credited. Ask your insurer which actions it recognizes and what discount applies.
- Appeal in writing if your mitigation isn't reflected, and track the 10- and 30-day deadlines.
Bottom line
In Colorado, wildfire mitigation work should count toward your rating or a discount, and you're entitled to see your score. Keep records of the work you do. See wildfire mitigation insurance discounts.
