Short answer: Your Connecticut landlord's policy doesn't cover your belongings. Under C.G.S. §47a-21, a deposit can't exceed two months' rent, or one month's rent if you're 62 or older. It must be held in escrow, and it earns interest. The landlord must return the deposit plus interest, minus itemized damages, within 21 days after the tenancy ends or 15 days after receiving your written forwarding address, whichever is later. A violation can make the landlord liable for twice the deposit.
This guide is general information for Connecticut renters. It isn't legal advice, and local ordinances can add rules. Your lease and policy wording control.
Your landlord's policy covers the building, not your belongings or liability. A renters policy (HO-4) covers personal property, personal liability and loss of use; flood is generally excluded (see FloodSmart). Coverage basics: renters insurance. Roommates: whether renters insurance covers roommates. Liability: how much renters liability coverage you need.
Step 1: Deposit caps
Under C.G.S. §47a-21, a deposit can't exceed two months' rent, or one month's rent if you're 62 or older. If you turn 62 after paying a larger deposit, the landlord must return the excess on your request.
Step 2: Escrow and interest
- The landlord must put the deposit in an escrow account at a financial institution.
- Within 30 days, the landlord must give you written notice of the amount held and the name and address of the institution.
- Deposits earn interest at no less than the state's deposit index rate. Interest is paid or credited annually on the anniversary of your tenancy.
Step 3: The 21-day rule
Give the landlord your forwarding address in writing. The landlord must then deliver the deposit and accrued interest, minus damages listed in a written itemized statement. The deadline is 21 days after the tenancy ends or 15 days after receiving your written forwarding address, whichever is later.
Step 4: Penalty
A landlord who violates the return rule is liable for twice the amount of the security deposit. If the only violation is unpaid interest, the liability is $10 or twice the interest, whichever is greater. Complaints can also go to the Banking Commissioner.
Step 5: Storms
Renters insurance typically covers your belongings for wind and winter damage. Flood is generally excluded; see FloodSmart.
