Georgia homeowners insurance claim deadlines

By Alishahi Insurance, independent broker · CA License #4348151 · Updated October 2026

Short answer: Under Georgia insurance regulation 120-2-52-.03, your insurer must acknowledge a property damage claim within 15 days. It must also send any proof-of-loss forms within 15 days, and it must accept or deny the claim within 15 days of receiving your completed proof of loss. If no proof of loss is required, the deadline is 30 days from when you reported the claim. If it needs more time, it must tell you why, and the total generally can't exceed 60 days unless you still owe requested information.

The timeline

From Ga. Comp. R. & Regs. 120-2-52-.03:

StepDeadline
Acknowledge your claim15 days after notice
Send proof-of-loss forms15 days after notice
Accept or deny15 days after the completed proof of loss (30 days after the report if no proof of loss is required)
Explain a delayWithin 5 business days after that deadline passes
Overall limit60 days, unless requested information is outstanding

Notice given to your agent counts as notice to the insurer.

What to do

The Georgia Office of Insurance claim tips say to report claims promptly, make temporary repairs to prevent further damage, keep receipts, and photograph the damage before you fix it.

If the deadlines are missed

First ask your insurer to fix the problem. If it doesn't, file a complaint with OCI Consumer Services. Include your policy and claim numbers and copies of your letters with the insurer.

If you can't find coverage at all, OCI's homeowners guide points to the Georgia FAIR Plan.
