Short answer: If you can't resolve a problem with your insurer or agent, you can file a free Request for Assistance with the California Department of Insurance (CDI). File online through the Consumer Complaint Center or call the Consumer Hotline at 1-800-927-4357. Attach your policy declarations page, letters from the insurer and any denial letters. CDI then asks the company to respond and reviews whether it followed the law and your policy.
Before you file
Write to your insurer and ask it to fix the problem. Keep copies of everything, and write down the date of each call and who you spoke with.
How to file
- Online: the CDI Consumer Complaint Center
- Phone: 1-800-927-4357 (TTY 1-800-482-4833), per CDI's contact page
- Form: CDI's Request for Assistance for non-health issues
What to attach
According to CDI's Getting Help page:
- Your policy declarations page
- Letters between you and the insurer or agent
- Claim denial letters
- Canceled checks or receipts
What happens next
CDI's Consumer Services Division sends your complaint to the company, asks for its response and reviews the case. CDI can't act as your lawyer. Some issues, including most HMO matters, belong to other regulators.
