Short answer: Your Indiana landlord's policy doesn't cover your belongings. Under IC 32-31-3-12, the landlord must return your deposit minus accrued rent, damages and certain unpaid utility charges. Every deduction must be itemized in a written notice delivered within 45 days after the agreement ends and you deliver possession. The landlord isn't liable until you supply a mailing address in writing. If the landlord fails to comply, you may recover the deposit due plus reasonable attorney's fees.
This guide is general information for Indiana renters. It isn't legal advice, and local ordinances can add rules. Your lease and policy wording control.
Your landlord's policy covers the building, not your belongings or liability. A renters policy (HO-4) covers personal property, personal liability and loss of use; flood is generally excluded (see FloodSmart). Coverage basics: renters insurance. Roommates: whether renters insurance covers roommates. Liability: how much renters liability coverage you need.
Step 1: Give your address in writing
Under IC 32-31-3-12, the landlord isn't liable until you supply a mailing address in writing. Do this when you move out.
Step 2: The 45-day notice
Within 45 days after the rental agreement ends and you deliver possession, the landlord must return the deposit, minus deductions itemized in a written notice. Deductions can cover:
- accrued rent,
- damages from your noncompliance with the law or the lease, and
- unpaid utility or sewer charges the lease made your responsibility.
Unless otherwise agreed, you can't apply the deposit to rent.
Step 3: Remedy
If the landlord fails to comply, you may recover all of the deposit due plus reasonable attorney's fees.
Step 4: Storms
Renters insurance typically covers your belongings for wind and hail damage. Flood is generally excluded; see FloodSmart.
