Is Workers' Comp Required in Louisiana?

By Alishahi Insurance, independent broker · CA License #4348151 · Updated October 2026

Short answer: Yes. Louisiana employers must carry workers' compensation even if they have only one employee, whether full-time, part-time, temporary or seasonal, according to the Louisiana Workforce Commission. Employers can't deduct premiums from paychecks. Uninsured employers face fines up to $250 per employee for a first violation and $500 per employee after, plus possible criminal charges.

One employee triggers the requirement

The Workforce Commission's employer coverage FAQ answers the headcount question directly: employers in Louisiana must maintain workers' compensation insurance even if they only have one employee, including part-time, full-time, temporary or seasonal workers.

Ways to comply

The Office of Workers' Compensation lists three options: buy a policy from an insurer authorized in Louisiana, qualify as an individual self-insurer, or join an approved group self-insurance fund. Louisiana Workers' Compensation Corporation (LWCC) writes coverage for employers who struggle to find it elsewhere.

Premiums can't come out of wages

Louisiana law prohibits employers from making employees pay for workers' comp, including workers who have been misclassified as independent contractors. Violators can face civil and criminal fines and possible jail time.

Penalties for going uninsured

According to the Commission:

  • Up to $250 per employee for a first violation
  • Up to $500 per employee for later violations, with a cap of $10,000 for related violations
  • Criminal charges for willful failure to provide coverage

Out-of-state employers

The Commission's FAQ addresses out-of-state employers separately. If your employees work in Louisiana, ask your carrier to confirm that your policy extends there, and get that confirmation in writing before the job starts.

Contractors and the statutory employer rule

Louisiana's statutory employer doctrine can make a principal contractor responsible for benefits owed to an uninsured subcontractor's workers. Collect certificates of insurance from every subcontractor.
