Is Workers' Comp Required in Mississippi?

By Alishahi Insurance, independent broker · CA License #4348151 · Updated October 2026

Short answer: Mississippi requires workers' compensation when an employer regularly uses five or more workers in the same business or establishment. The five need not work the same shift. Nonprofit charitable, fraternal, cultural and religious organizations are among the exemptions. Uninsured employers face criminal and civil penalties, and injured workers may sue in tort without certain defenses.

The five-employee test

The 2016 Mississippi Workers' Compensation Claims Guide, published for the Mississippi Workers' Compensation Educational Association, quotes § 71-3-5 and explains the practical test: look at the size of the operation and whether five or more employees are regularly used. If the answer is yes, coverage is necessary; if in doubt, the guide encourages the employer to obtain coverage.

Employees need not all work the same shift. Seasonal spikes that show a regular need for five or more workers can still trigger the Act.

Exemptions that ignore headcount

Certain employers are outside the coverage requirements regardless of how many workers they employ. The guide lists nonprofit charitable organizations and fraternal, cultural or religious corporations or associations among the exempted categories. Domestic and farm labor exclusions also appear in the statutory scheme; confirm the current text of § 71-3-5 before relying on any exemption.

How to secure coverage

Employers subject to the Act generally:

  • Buy a workers' compensation policy from an authorized carrier,
  • Apply to the Mississippi Workers' Compensation Commission to become a self-insurer after showing financial ability to pay compensation, or
  • Join a Commission-regulated group self-insurance fund made up of members of the same bona fide Mississippi trade association or trade group (§ 71-3-75).

Employers who cannot find coverage in the voluntary market may go through the Mississippi Workers' Compensation Assigned Risk Plan administered by the Commissioner of Insurance (§ 71-3-111).

Notice of coverage and proof to the Commission

An employer must post a Notice of Coverage form on the premises with coverage details under § 71-3-81 and Commission Rule 1.8. Proof of coverage must also be provided to the Commission under Rule 1.3; reporting is typically handled through the carrier's electronic filings.

What happens if you refuse coverage

An employer who fails to secure compensation when required faces statutory criminal and civil penalties under § 71-3-83. An injured employee may choose to sue the employer in tort or proceed against the employer under the Act (§ 71-3-9). If the employee sues in tort, the uninsured employer may not plead the fellow-servant defense or assumption of the risk.

Group self-insurance and assigned risk in practice

Trade-association group funds under § 71-3-75 are limited to Mississippi-domiciled members of the same bona fide association. They are not a casual alternative to a standard policy. Assigned-risk placements under § 71-3-111 exist for risks that in good faith are entitled to insurance but cannot obtain it because of unusual conditions. Both paths still require Notice of Coverage posting and Commission reporting.

Claims choice that should motivate coverage

Section 71-3-9's choice between a tort suit and a claim under the Act is the practical reason small employers near the five-employee line buy coverage early. Defending a negligence suit without the fellow-servant or assumption-of-risk defenses is usually far more expensive than a workers' compensation premium on a modest payroll.

Domestic and farm labor

Alongside the nonprofit exemptions, Mississippi's workers' compensation scheme has long treated certain domestic and farm labor categories as outside the compulsory five-employee rule. The details live in § 71-3-5 and related sections; because the Claims Guide summarizes rather than reprints every clause, employers in those industries should read the current Code text or ask the Commission before operating without a policy on a large seasonal crew that may still meet the "regularly" test.

Commission proof and posting checklist

Before opening day, confirm three items: a policy or approved self-insurance authority is active, proof has been reported to the Commission, and the Notice of Coverage is posted where employees can see it. Skipping the poster is a separate compliance failure from skipping the policy, and both appear in Commission rules and § 71-3-81.

Bottom line

Mississippi's five-employee threshold is real, but "regularly" is broader than a single day's headcount. When in doubt, insure. See our workers' compensation insurance overview.
