Kansas Minimum Car Insurance Requirements

By Alishahi Insurance, independent broker · CA License #4348151 · Updated October 2026

Short answer: Every Kansas auto policy must carry three things: 25/50/25 liability, personal injury protection (PIP) and uninsured/underinsured motorist coverage at 25/50. PIP pays your own medical bills, lost income and related costs no matter who caused the crash. You can sue for pain and suffering only past a $2,000 medical threshold or a listed serious injury.

The mandatory package

The Kansas Insurance Department's auto shopper's guide lists the required coverages and limits:

CoverageKansas minimum
Bodily injury liability$25,000 per person / $50,000 per accident
Property damage liability$25,000 per accident
PIP medical expenses$4,500 per person
PIP disability / lost income$900 per month for one year
PIP substitution benefits$25 per day
PIP funeral, burial or cremation$2,000
PIP rehabilitation$4,500
PIP survivor benefits$900 per month for one year, plus $25 per day substitution
Uninsured/underinsured motorist$25,000 per person / $50,000 per accident

"Substitution benefits" reimburse you for paying someone to do household tasks you can't do while injured.

How PIP works in Kansas

The guide describes PIP as coverage for you and your passengers after an accident, regardless of who is at fault. Your own insurer pays first, so you don't wait for a liability decision before medical bills get covered.

PIP medical tops out at $4,500, which doesn't go far. The department notes you can buy excess medical payments coverage that pays over and above Kansas no-fault benefits.

The tort threshold

No-fault limits lawsuits, but it doesn't eliminate them. Under K.S.A. 40-3117, you can recover damages for pain, suffering, mental anguish and other non-economic losses only if the injury:

  • requires medical treatment with a reasonable value of $2,000 or more, or
  • involves permanent disfigurement, or
  • is a fracture of a weight-bearing bone, or a compound, comminuted, displaced or compressed fracture, or
  • is the loss of a body member, or
  • is a permanent injury or permanent loss of a bodily function, or
  • results in death.

Below that line, PIP is your recovery for the injury. Claims for vehicle damage aren't limited by the threshold.

When a lawsuit is allowed, Kansas compares fault. Under K.S.A. 60-258a, you recover only if your negligence is less than that of the party you're claiming against, and your award is reduced by your share.

UM and UIM rules

K.S.A. 40-284 requires uninsured motorist coverage, including underinsured protection, in every policy. Key details:

  • The UM limit generally matches your bodily injury liability limit.
  • You can reject, in writing, only the portion above the 25/50 statutory minimum. The minimum itself stays.
  • A rejection by the named insured applies to everyone on the policy and carries into later policies with the same insurer unless you request the coverage in writing.
  • The statute's anti-stacking language generally limits you to the highest single limit.

Proof and penalties

You'll show proof of insurance when you register or renew a vehicle, when an officer asks, and after an accident. Under K.S.A. 40-3104, proof can be shown on a phone, and the officer may look only at the insurance information.

Driving uninsured is a crime:

  • First offense: class B misdemeanor, $300 to $1,000, up to six months in jail, or both.
  • Another conviction within three years: class A misdemeanor, $800 to $2,500.

You won't be convicted if you produce, in court within 10 days of the citation, proof of coverage that was valid at the time. After a crash without coverage, the state can also suspend driver's licenses and revoke registrations of the vehicles involved.

Ways to keep premiums manageable

From the department's own tips:

  • Consider liability-only coverage on vehicles worth less than $3,000.
  • Raise comprehensive and collision deductibles.
  • Ask about driver safety course discounts.
  • Keep a clean record. Insurers may rate chargeable accidents for three to five years.

Bottom line

Kansas bundles liability, PIP and UM/UIM into every policy. Know the $2,000 threshold, and decide whether $4,500 of PIP medical is enough. Compare other states in our car insurance minimums by state table.
