Short answer: In Michigan, your landlord's policy doesn't cover your belongings or liability. Under Michigan's security deposit law (MCL 554.602), deposits can't exceed 1.5 months' rent. Within 4 days after you move out, give your landlord a forwarding address in writing (MCL 554.611). If the landlord claims damages, they must mail an itemized notice within 30 days (MCL 554.609). The notice must warn you to respond by mail within 7 days of receiving it, or you forfeit the amount claimed.
This guide is general information for Michigan renters. It isn't legal advice, and local ordinances can add rules. Your lease and policy wording control.
Your landlord's policy covers the building, not your belongings or liability. A renters policy (HO-4) covers personal property, personal liability and loss of use; flood is generally excluded (see FloodSmart). Coverage basics: renters insurance. Roommates: whether renters insurance covers roommates. Liability: how much renters liability coverage you need.
Step 1: Deposit cap
Under MCL 554.602, a security deposit can't exceed 1½ months' rent.
Step 2: Give your address within 4 days
Under MCL 554.611, you must notify the landlord in writing within 4 days after your occupancy ends of an address where you can receive notices. If you don't, the landlord is relieved of the notice-of-damages requirement, though your later claim for the deposit isn't lost.
Step 3: The 30-day notice of damages, and your 7-day reply
Under MCL 554.609:
- If the landlord claims damages or other obligations, they must mail an itemized notice within 30 days after your occupancy ends, with the estimated cost of each repair and the amounts and bases for charges.
- The notice generally comes with payment of the difference between the claim and the deposit.
- The notice must tell you, in bold type, that you must respond by mail within 7 days after receiving it, or you forfeit the amount claimed. Reply in writing, in detail, and keep proof of mailing.
Step 4: Winter and water
Burst pipes and ice damage are common Michigan claims. Renters insurance typically covers your belongings for sudden water damage. Flood and, often, sewer backup need separate coverage or an endorsement; see FloodSmart.
