Short answer: In Missouri, tornadoes and severe storms make renters insurance worth having, since your landlord's policy doesn't cover your belongings. Under RSMo §535.300, a landlord can't demand or receive a security deposit of more than two months' rent. Within 30 days after the tenancy ends, the landlord must return the full deposit, or give you a written itemized list of damages along with the balance. Ordinary wear and tear can't be deducted. Wrongful withholding can cost the landlord up to twice the amount withheld.
This guide is general information for Missouri renters. It isn't legal advice, and local ordinances can add rules. Your lease and policy wording control.
Your landlord's policy covers the building, not your belongings or liability. A renters policy (HO-4) covers personal property, personal liability and loss of use; flood is generally excluded (see FloodSmart). Coverage basics: renters insurance. Roommates: whether renters insurance covers roommates. Liability: how much renters liability coverage you need.
Step 1: Deposit cap
Under RSMo §535.300, the deposit can't exceed two months' rent. Deposits must be held in a federally insured institution. Missouri law says interest earned belongs to the landlord.
Step 2: The 30-day rule
- Within 30 days after the tenancy ends, the landlord must return the full deposit or give you a written itemized list of damages with the balance. Mailing to your last known address counts, so give your new address.
- The landlord may withhold only amounts reasonably necessary for unpaid rent, restoring the unit to its move-in condition (ordinary wear and tear excepted), and certain other listed items.
- The landlord must give you reasonable written or in-person notice of the move-out inspection date and time, and you have the right to be present.
Step 3: Penalty
If the landlord wrongfully withholds all or part of the deposit, you may recover up to twice the amount wrongfully withheld.
Step 4: Tornado and hail season
A renters policy typically covers your belongings for wind and hail damage and provides loss of use if the unit becomes unlivable. Flood is generally excluded; see FloodSmart.
