New Hampshire Car Insurance and Financial Responsibility

By Alishahi Insurance, independent broker · CA License #4348151 · Updated October 2026

Short answer: New Hampshire does not require every driver to buy auto insurance. You must still pay for harm you cause. After an at-fault crash or certain convictions, DMV can demand proof of financial responsibility—usually an SR-22—at $25,000/$50,000/$25,000. If you purchase a personal auto policy, at least $1,000 of medical payments and matching uninsured motorist coverage come with it.

Insurance is optional; responsibility is not

The New Hampshire Insurance Department's 2022 Automobile Insurance Consumer FAQ states the rule directly: New Hampshire motor vehicle laws do not require you to carry auto insurance, but you must be able to demonstrate that you can meet New Hampshire financial responsibility requirements after an at-fault accident. If you cannot, your driving privileges may be suspended. A court can order your assets used to pay damages awarded against you.

That is why most drivers still buy a policy. Going bare means paying medical bills, property damage and legal defense out of pocket.

When the DMV requires an SR-22

The NH Division of Motor Vehicles Insurance Requirements / SR-22 page says the DMV may require persons to have insurance (SR-22) and will notify you in writing if you fall under a filing requirement. Your driver record report will say either "No proof of financial responsibility is required" or "Proof of financial responsibility is required."

Until the filing is met, license, operating and registration privileges cannot be restored or retained. The only document DMV accepts is the uniform SR-22 certificate from an insurer licensed in New Hampshire—not a form from DMV, and not a certificate from an agent alone. DMV recognizes "Owner" SR-22 (own, register and operate) and "Operator" SR-22 (operate only).

Convictions that require filing include any DWI, Leaving the Scene of an Accident / Conduct After Accident, and a subsequent (second) Reckless Operation offense. Relief of filing comes only after DMV reviews your record and issues a formal Notice of Relief of Filing.

The dollar amounts of proof

RSA 264:20 sets the amount of proof of financial responsibility at $25,000 for bodily injury or death of one person, $50,000 for two or more persons in one accident, and $25,000 for property damage. Those same numbers are the minimum liability limits available when you buy a New Hampshire auto policy, according to the Insurance Department FAQ.

If you do buy a policy

Buying insurance triggers two additional mandates the FAQ cites:

  • Medical payments of at least $1,000 under RSA 264:16, paid regardless of fault for a period of three years after the injury.
  • Uninsured motorist coverage under RSA 264:15 at limits equal to your auto liability coverage.

Collision and comprehensive remain optional unless a lender requires them. UM in New Hampshire generally covers bodily injury, not damage to your own car.

Why most New Hampshire drivers still buy a policy

The Insurance Department FAQ walks through the personal risk clearly. Even when you are not at fault, you can face substantial medical costs. When you are at fault, a judgment can reach your savings, wages and property. A liability policy pays covered claims and typically includes a defense. Physical damage coverages—collision and comprehensive—remain optional unless a lender requires them, but without them you fund your own repairs after hail, theft or a crash.

Total-loss rules in New Hampshire are detailed in Insurance Department administrative rules. Generally, when repair cost exceeds about 75% of fair market value, a vehicle may be declared a total loss under RSA 261:22, and insurers must pay fair market value using Department-approved methods. Those consumer protections assume you have a policy in force to begin with.

Owner versus operator filings

An Owner SR-22 lets you own, register and operate a vehicle. An Operator SR-22 only authorizes operation. Choosing the wrong certificate type is a common reason privileges stay suspended after someone thinks they "got insurance." Confirm with DMV and the carrier which box the SR-22 certificate must check before you pay the premium.

Bottom line

New Hampshire is unusual: no mandatory policy for every driver, but real financial-responsibility consequences after a crash or listed conviction. Most people still buy at least 25/50/25 with MedPay and UM. Compare states in our car insurance minimums by state table.
