Texas clarifies: insurers can't drop homes based only on house or roof age

HomeNews

The Texas Department of Insurance says companies may not decline or non-renew a home policy simply because a house or its roof is older.

What TDI announced

On September 29, 2026, the Texas Department of Insurance (TDI) said it is clarifying its rule on home insurance decisions. Insurance companies can't decline or not renew a home policy based on the age of a house or its roof.

The rule also covers other components, including wiring, heating, air conditioning, plumbing, and siding. Age alone is not a permitted reason.

What insurers can still consider

Insurers may still base decisions on the physical condition of the home or its components. That includes roofing, wiring, heating, air conditioning, plumbing, and siding.

The difference is between condition and age. A worn roof can still affect a decision. A roof that is simply older cannot be the only reason.

Why TDI acted

TDI developed the rule in response to Governor Greg Abbott's directive to support Texas homeowners. That directive included stopping insurers from rejecting policies based solely on the age of a house or its components.

Insurance Commissioner Amanda Crawford said, "Texans deserve fair access to home insurance, no matter the age of their home." TDI describes the rule as one of several actions meant to help make auto and home insurance more affordable.

Who this affects

Texas homeowners with older houses, roofs, or other older components are most affected. That includes people who were declined or non-renewed and wondered whether age was the reason.

Call (877) 711-4545 to talk through a decline, a non-renewal notice, or a policy review.

What it means

  • Age of the house or roof alone is not a valid reason to decline or non-renew a Texas home policy.
  • Insurers can still weigh the actual physical condition of the roof, wiring, plumbing, heating, air conditioning, and siding.
  • Homeowners who were previously declined or non-renewed may want to take another look at their options.
  • Documented condition and maintenance of the home may matter more than how old it is.

What to do

  • If you received a decline or non-renewal notice, read the stated reason and note whether it cites age or condition.
  • Gather records of roof, wiring, plumbing, and HVAC repairs or replacements.
  • Ask your insurer in writing why a policy was declined or non-renewed.
  • Call the TDI Help Line at 800-252-3439 with questions or concerns.
  • Contact Alishahi Insurance at (877) 711-4545 for help reviewing options. The agency helps anyone, client or not.
