North Carolina life insurance consumer guide

By Alishahi Insurance, independent broker · CA License #4348151 · Updated October 2026

Short answer: North Carolina individual life policies must give a 31-day grace period for premiums after the first, during which death benefit coverage continues. If an insurer doesn't pay a death claim within 30 days after satisfactory proof of loss, it owes interest from the date of death.

This guide is general consumer information for North Carolina life insurance buyers. It isn't legal advice or a coverage determination. Policy wording, underwriting and the statutes linked below control.

31-day grace period

G.S. 58-58-22 (individual policy standard provisions) requires a grace period of 31 days for any premium due except the first, during which death benefit coverage continues in force. The policy may provide that a claim arising during grace has any overdue premium deducted from the settlement. The same section requires a two-year incontestability clause, except for nonpayment of premium.

Interest on slow death claims

G.S. 58-58-110 says that if an insurer fails or refuses, without the beneficiary's written consent, to pay death proceeds within 30 days after receipt of satisfactory proof of loss, it must pay interest at not less than the then-current rate on death proceeds left on deposit, computed from the date of the insured's death, on amounts unpaid after that 30-day window. Satisfactory proof can include a certified death certificate or a written statement from the attending physician with the required details.
