Short answer: In North Carolina, hurricanes and inland flooding make renters insurance and separate flood coverage worth a look, since your landlord's policy doesn't cover your belongings. Under G.S. 42-51, deposits are capped at two weeks' rent for week-to-week tenancies, one and one-half months' rent for month-to-month, and two months' rent for longer terms. Under G.S. 42-52, the landlord must itemize any damage and return the balance within 30 days after the tenancy ends and you deliver possession. If the claim can't be settled by then, an interim accounting is due at 30 days and a final one within 60.
This guide is general information for North Carolina renters. It isn't legal advice, and local ordinances can add rules. Your lease and policy wording control.
Your landlord's policy covers the building, not your belongings or liability. A renters policy (HO-4) covers personal property, personal liability and loss of use; flood is generally excluded (see FloodSmart). Coverage basics: renters insurance. Roommates: whether renters insurance covers roommates. Liability: how much renters liability coverage you need.
Step 1: Deposit caps
Under G.S. 42-51, security deposits may not exceed:
- Two weeks' rent for a week-to-week tenancy
- One and one-half months' rent for a month-to-month tenancy
- Two months' rent for terms longer than month-to-month
Step 2: The 30-day accounting
Under G.S. 42-52:
- The landlord must itemize any damage in writing and mail or deliver it with the balance no later than 30 days after the tenancy ends and you deliver possession.
- If the claim can't be determined in 30 days, the landlord must send an interim accounting by day 30 and a final accounting within 60 days.
- If your address is unknown, the landlord holds the balance for you for at least six months. Give a forwarding address.
- No deduction for normal wear and tear, and deductions can't exceed actual damages.
Step 3: Hurricane season
Wind damage to belongings is typically covered by a renters policy, subject to deductibles. Flood, including from hurricane rain, is generally excluded, and renters can buy NFIP contents coverage through FloodSmart. Loss-of-use coverage helps if a storm makes the unit unlivable.
