North Dakota renters insurance and security deposit guide

By Alishahi Insurance, independent broker · CA License #4348151 · Updated October 2026

Short answer: Your North Dakota landlord's policy doesn't cover your belongings. Under N.D.C.C. §47-16-07.1, a deposit generally can't exceed one month's rent, with limited exceptions and a separate pet deposit. The deposit must be held in a federally insured interest-bearing account. Interest is owed if your occupancy lasted nine months or longer. Within 30 days after the lease ends and you deliver possession, the landlord must mail or deliver an itemization and written notice of the refund due.

This guide is general information for North Dakota renters. It isn't legal advice, and local ordinances can add rules. Your lease and policy wording control.

Your landlord's policy covers the building, not your belongings or liability. A renters policy (HO-4) covers personal property, personal liability and loss of use; flood is generally excluded (see FloodSmart). Coverage basics: renters insurance. Roommates: whether renters insurance covers roommates. Liability: how much renters liability coverage you need.

Step 1: Deposit cap and account

Under N.D.C.C. §47-16-07.1, a landlord generally can't demand more than one month's rent. The statute allows up to two months for certain applicants, such as someone with a prior judgment for violating a rental agreement. A separate pet deposit is also allowed. The deposit must be held in a federally insured interest-bearing account for your benefit.

Step 2: Interest

The deposit and its accrued interest are paid to you when the lease ends. The landlord doesn't have to pay interest if your occupancy lasted less than nine months.

Step 3: The 30-day itemization

Within 30 days after the lease ends and you deliver possession, the landlord must deliver or mail to the last address you furnished an itemization of any amount kept, the amount due, and a written notice.

Step 4: Winter and storms

Renters insurance typically covers your belongings for burst pipes, fire and wind, and pays additional living expenses if the unit becomes unlivable. Flood is generally excluded; see FloodSmart.
