Oklahoma Minimum Car Insurance Requirements

By Alishahi Insurance, independent broker · CA License #4348151 · Updated October 2026

Short answer: Oklahoma's Compulsory Insurance Law requires at least $25,000 of bodily injury liability per person, $50,000 per accident and $25,000 for property damage. Uninsured motorist coverage must be offered, and you can only decline it in writing. Driving uninsured is a misdemeanor that can bring a fine, jail, license suspension, and seizure of your plate or vehicle.

The required limits

The Oklahoma Insurance Department states the minimum liability coverage as 25/50/25:

CoverageMinimum
Bodily injury, per person$25,000
Bodily injury, per accident$50,000
Property damage, per accident$25,000

The department cautions that the minimum likely won't be enough after a serious accident. It notes a general industry recommendation of 100/300/100.

Uninsured motorist: offered, not forced

Under 36 O.S. §3636, insurers must offer uninsured motorist coverage on a form approved by the Insurance Commissioner, and a named insured can reject it only in writing. You can also buy UM up to your bodily injury liability limits. For policies issued, renewed or reinstated after November 1, 2014, limits can't be stacked unless the insurer expressly allows it.

A rejection lasts. The statute says it stays valid for the life of the policy, including renewals and replacements by the same insurer, applies to everyone on the policy, and continues until a named insured asks in writing to add UM. The insurer doesn't have to remind you at renewal.

How coverage is checked

Oklahoma uses an online verification system. Under 47 O.S. §7-606, if a law enforcement officer confirms valid, current coverage through that system, there's no violation and no citation, even if you can't find your insurance card.

Penalties for driving uninsured

Section 7-606 makes failing to comply with the Compulsory Insurance Law a misdemeanor. On conviction:

  • a fine of up to $250, up to 30 days in jail, or both; and
  • suspension of the driving privilege under §7-605.

When issuing the citation, an officer may also:

  • Seize and tow the vehicle if there's probable cause it's uninsured; or
  • Seize the license plate. If the car is drivable, the citation serves as a temporary plate for up to 10 days. To get the plate back, you need proof of insurance, a $125 administrative fee, and full payment of the citation.

Who's covered when someone borrows your car

The Insurance Department says the owner's liability insurance in Oklahoma generally follows the car when the owner gave the driver permission. Collision and comprehensive are also tied to the vehicle. If the owner has no liability insurance, the driver is required to carry it.

Fault: you can still recover at 50%

Oklahoma uses modified comparative negligence. Under 23 O.S. §13, a plaintiff's negligence doesn't bar recovery unless it's "of greater degree" than the defendant's. In practice, a driver found 50% at fault can still recover a reduced amount, but not at 51% or more.

Coverage the minimum leaves out

The department lists several things a liability-only policy won't pay for:

  • theft;
  • vandalism;
  • falling tree limbs;
  • hail;
  • flood; and
  • fire.

Those come under comprehensive, which is optional unless a lender requires it, as is collision. If your car would be costly to replace, weigh comprehensive carefully.

Scenarios

An officer pulls you over in Tulsa and your card is expired. If the online system shows a valid policy, the law says no citation issues.

You lend your truck to a friend in Norman. Your liability policy generally covers a permissive driver, so your limits matter even when you're not driving.

Choosing limits

Liability should reflect what you could lose in a lawsuit. If you own a home or have savings, review higher limits and an umbrella policy. If you rejected UM years ago, remember that the rejection stays in place until you ask in writing to add it back. Compare states on our car insurance minimums by state page.

Bottom line

Oklahoma's floor is 25/50/25 with UM offered on a written-rejection basis. Enforcement relies on online verification, with plate seizure and towing as tools. Buy the coverage you'd want after a bad day on the turnpike, not just the legal minimum.
