Short answer: In Oklahoma, tornadoes and hail make renters insurance worth having, since your landlord's policy doesn't cover your belongings. Under 41 O.S. §115, the landlord must return the deposit balance within 45 days after three things have happened: the tenancy has ended, you have delivered possession, and you have made a written demand. If you don't make a written demand within six months after the tenancy ends, the deposit reverts to the landlord.
This guide is general information for Oklahoma renters. It isn't legal advice, and local ordinances can add rules. Your lease and policy wording control.
Your landlord's policy covers the building, not your belongings or liability. A renters policy (HO-4) covers personal property, personal liability and loss of use; flood is generally excluded (see FloodSmart). Coverage basics: renters insurance. Roommates: whether renters insurance covers roommates. Liability: how much renters liability coverage you need.
Step 1: Escrow
Under 41 O.S. §115, the landlord must keep any damage or security deposit in an escrow account for you, maintained in Oklahoma with a federally insured financial institution. Misappropriating a deposit is unlawful and can be punished by up to six months in county jail and a fine of up to twice the amount misappropriated.
Step 2: Make a written demand
The landlord must return the balance within 45 days after the tenancy ends, you deliver possession, and you make a written demand. Send the demand in writing and keep a copy. If you don't make a written demand within six months after the tenancy ends, the deposit reverts to the landlord.
Step 3: Itemized deductions
The landlord may apply the deposit to accrued rent and to damages from your noncompliance with the act and the lease. The deductions must be itemized in a written statement delivered as the statute requires.
Step 4: Tornado and hail
Renters insurance typically covers belongings for wind and hail damage, and pays additional living expenses if the unit becomes unlivable. Flood is generally excluded; see FloodSmart.
