Pennsylvania renters insurance and security deposit guide

By Alishahi Insurance, independent broker · CA License #4348151 · Updated October 2026

Short answer: In Pennsylvania, your landlord's policy doesn't cover your belongings or liability, so renters insurance fills that gap. Under the Landlord and Tenant Act of 1951, a landlord can't require more than two months' rent as a deposit in the first year of a lease, or more than one month's rent in the second and later years. Within 30 days after the lease ends or the premises are surrendered and accepted, the landlord must give you a written list of damages along with the balance. If they don't, they forfeit the right to withhold any of it.

This guide is general information for Pennsylvania renters. It isn't legal advice, and local ordinances can add rules. Your lease and policy wording control.

Your landlord's policy covers the building, not your belongings or liability. A renters policy (HO-4) covers personal property, personal liability and loss of use; flood is generally excluded (see FloodSmart). Coverage basics: renters insurance. Roommates: whether renters insurance covers roommates. Liability: how much renters liability coverage you need.

Step 1: Deposit limits

Under 68 P.S. §250.511a of the Landlord and Tenant Act of 1951 (copy published by the City of Reading):

  • First year: no more than two months' rent in escrow.
  • Second and later years (or renewals): no more than one month's rent.
  • After five years of tenancy, rent increases can't require a matching deposit increase.
  • Under §250.511b, after two years, deposits over $100 must be held in an interest-bearing account, and you get the interest, less a 1% administrative fee.

Step 2: The 30-day damage list

Under §250.512:

  • Within 30 days after the lease ends or the premises are surrendered and accepted, whichever comes first, the landlord must give you a written list of damages with payment of the difference between the deposit (plus unpaid interest) and actual damages.
  • If the landlord fails to provide the list within 30 days, they forfeit all rights to withhold any portion, and the right to sue you for damage to the premises.
  • If the landlord doesn't pay the balance within 30 days, they can be liable for double the amount by which the deposit exceeds actual damages.
  • Give a written forwarding address when you leave so the list and payment reach you.

Step 3: Winter water damage

Frozen and burst pipes are common Pennsylvania claims. Renters insurance typically covers your belongings for sudden water damage. Flood and, often, sewer backup need separate coverage or an endorsement; see FloodSmart.
