Short answer: Your Utah landlord's policy doesn't cover your belongings. Under Utah Code §57-17-3, within 30 days after you move out and return possession, the owner must send you the balance of the deposit and any prepaid rent. If anything was deducted, they must also send a written notice itemizing and explaining each deduction. If they don't, you can serve a notice, and the owner then has five business days to comply.
This guide is general information for Utah renters. It isn't legal advice, and local ordinances can add rules. Your lease and policy wording control.
Your landlord's policy covers the building, not your belongings or liability. A renters policy (HO-4) covers personal property, personal liability and loss of use; flood is generally excluded (see FloodSmart). Coverage basics: renters insurance. Roommates: whether renters insurance covers roommates. Liability: how much renters liability coverage you need.
Step 1: The 30-day rule
Under Utah Code §57-17-3, within 30 days after you vacate and return possession, the owner or agent must mail or deliver the following to your last known address, or send them electronically by a means you provided:
- the balance of your deposit,
- the balance of any prepaid rent, and
- a written notice itemizing and explaining each deduction.
Give your landlord a forwarding address or an email address.
Step 2: If the landlord misses the deadline
You can serve the owner with the notice the statute describes. The owner then has five business days to comply. If they still don't comply, §57-17-5 lets you recover the full deposit (and full prepaid rent, if that wasn't returned) plus a $100 civil penalty. You can also sue to enforce. If the court finds the other side acted in bad faith, it awards costs and attorney fees to the prevailing party.
Step 3: Wildfire, winter and earthquake
Renters insurance typically covers belongings for fire and smoke, and pays for additional living expenses if the unit becomes unlivable. Earthquake and flood are generally excluded. Ask about earthquake coverage for your belongings, and see FloodSmart for flood.
