Short answer: Your DC landlord's policy doesn't cover your belongings. Per the DC Tenant Bill of Rights, a deposit can't exceed the initial monthly rent and must be held in an interest-bearing account. Within 45 days after you vacate, the landlord must either return the deposit, with interest if you lived there 12 months or more, or give you written notice of amounts due. The balance is then due within 30 days after that notice. Ordinary wear and tear can't be charged.
This guide is general information for Washington, DC renters. It isn't legal advice, and local ordinances can add rules. Your lease and policy wording control.
Your landlord's policy covers the building, not your belongings or liability. A renters policy (HO-4) covers personal property, personal liability and loss of use; flood is generally excluded (see FloodSmart). Coverage basics: renters insurance. Roommates: whether renters insurance covers roommates. Liability: how much renters liability coverage you need.
Step 1: Deposit cap and interest
Per the DC Tenant Bill of Rights from the Office of the Tenant Advocate:
- The deposit can't exceed the initial monthly rent.
- It must be held in an interest-bearing account.
- Interest is owed for tenancies of 12 months or more.
Step 2: The 45-day rule
Within 45 days after you vacate, the landlord must either return the deposit, with interest where owed, or give you written notice of unpaid amounts. Within 30 days after that notice, the landlord must return the balance. You can also try to resolve any dispute during that time.
Step 3: Wear and tear
Repairs for damage caused by you or a guest are legitimate deductions. Ordinary wear and tear isn't. Under D.C. Code §42-3502.17, a housing provider can't withhold for the replacement value of items damaged by ordinary wear and tear. Complaints about deposits can be adjudicated by the Office of Administrative Hearings.
Step 4: Storms and flooding
Renters insurance typically covers your belongings for fire, theft and burst pipes. Flood is excluded; see FloodSmart.
