Restaurants sit on a spectrum. At one end, a café or a sit-down restaurant with modest alcohol sales fits many business owner’s policies and restaurant programs. At the other, a bar or nightclub with high liquor sales, late hours, dancing or entertainment is usually a surplus lines risk. Either way, liquor liability is excluded from general liability for businesses in the business of selling alcohol, so it has to be added or bought separately. Underwriters focus on the liquor percentage, the hours, the cooking, the fire suppression and the claims history.
Why some restaurants get declined
- Alcohol share of sales. The higher the percentage of revenue from alcohol, the fewer markets will write it. Many standard programs have a ceiling.
- Late hours. Staying open past midnight or so moves many risks out of standard appetite.
- Entertainment. Live music, DJs, dancing, cover charges, hookah and promoter nights are frequent reasons for a decline.
- Cooking. Open flame, wood-fired ovens, solid-fuel cooking and heavy deep frying raise the fire risk.
- Fire protection. A hood suppression system that isn’t serviced, or hood and duct cleaning that isn’t documented.
- Claims and experience. Prior fires, slip-and-falls, assaults or liquor claims, and a new owner with no restaurant history.

Liquor liability is its own question
General liability policies exclude liquor liability for businesses in the business of selling, serving or furnishing alcohol. If you hold a license and serve drinks, you need liquor liability added by endorsement or written as a separate policy — the general liability alone won’t answer a claim that a guest you served later hurt someone.
Bar and nightclub policies from surplus lines markets also often limit or exclude assault and battery, which is one of the most common claims in that class. Ask whether it is covered and at what limit before you buy. Liquor liability insurance.
What restaurant and bar underwriters look at
- Sales: total annual revenue and the split between food and alcohol.
- Hours and seating: closing time, number of seats, and any patio.
- Operations: entertainment, dancing, cover charges, security staff, delivery and catering.
- Cooking and fire protection: cooking methods, hood suppression service dates, hood and duct cleaning records, fire extinguishers.
- Building: owned or leased, construction, age, sprinklers, and what the lease requires you to insure.
- People: years of restaurant experience, payroll, employee count, and responsible-service training.
- Losses: at least three to five years of loss runs if you have prior coverage.
