Burn-scar mudflows in Los Angeles: what flood insurance covers

By Alishahi Insurance, independent broker · CA License #4348151 · Updated October 2026 · En español

Short answer: NFIP flood insurance covers mudflows, which FEMA defines as a river of liquid, flowing mud, often after brush is burned off and heavy rain follows (44 CFR §59.1). It doesn't cover landslides or erosion on their own, and most homeowners policies exclude both. The usual 30-day wait is waived if you buy within 60 days after a fire is contained and FEMA finds post-wildfire flooding from federal land affects your property.

Why burn scars change your flood risk

After a wildfire strips hillsides of brush, heavy rain runs off fast and can carry mud and debris into neighborhoods below. FEMA's own definition of a mudflow describes exactly that: a flow of liquid mud down a hillside, "usually as a result of a dual condition of loss of brush cover, and the subsequent accumulation of water on the ground preceded by a period of unusually heavy or sustained rain" (44 CFR §59.1).

Mudflow vs. landslide: the line that decides your claim

EventCovered as "flood" under the NFIP?Source
Mudflow: a river of liquid, flowing mud on normally dry land, caused by unusual and rapid runoffYes, it's part of the definition of flood44 CFR §59.1
Mudflow that happens during a landslideOnly if the mudflow, not the landslide, is the proximate cause of the damage44 CFR §59.1
Landslide, earth movement or erosion on its ownNo. FEMA says erosion "is not per se covered"44 CFR §59.1

Most homeowners policies exclude both flood and earth movement, so a burn-scar mudflow usually needs a flood policy to be covered. See our landslide and mudflow insurance guide for how homeowners policies treat earth movement.

Timing: the post-wildfire exception

NFIP policies usually take 30 days to start. Federal law waives that wait when FEMA determines your property is affected by flooding on federal land caused or worsened by post-wildfire conditions, and you buy within 60 days after the fire is contained (42 U.S.C. §4013(c)(2)(C)). Foothill homes below the Angeles National Forest, for example, should ask about this right after a fire. Details are in our NFIP 30-day waiting period guide.

Checklist for homes below a burn area

  1. Get a flood quote now, even outside a mapped flood zone.
  2. Photograph your home, yard and slopes before the rainy season.
  3. Insure contents separately, since NFIP building and contents are separate coverages.
  4. After a loss, document the mud's path (where it came from and how it flowed), because the mudflow vs. landslide question decides coverage.
  5. Rebuilding after the fire too? See wildfire rebuild insurance rights in Los Angeles.

Frequently asked questions

Does flood insurance cover mudflows after a wildfire?

NFIP flood insurance covers mudflows as part of its definition of flood: a river of liquid, flowing mud on normally dry land caused by unusual runoff (44 CFR §59.1). It doesn't cover landslides or erosion on their own.

Does homeowners insurance cover a burn-scar mudflow?

Usually not. Most homeowners policies exclude flood and earth movement, which is why a flood policy matters for homes below burn areas.

Is there a waiting period for flood insurance after a fire?

Normally 30 days, but 42 U.S.C. §4013(c)(2)(C) waives it when FEMA finds post-wildfire flooding from federal land affects your property and you buy within 60 days after containment.

What if a landslide and a mudflow happen together?

FEMA recognizes the mudflow only if the mudflow, not the landslide, is the proximate cause of the damage (44 CFR §59.1). Document how the mud moved.
