California life insurance free-look period and lapse notice rules

By Alishahi Insurance, independent broker · CA License #4348151 · Updated October 2026 · En español

Short answer: Every California life insurance policy must have a grace period of at least 60 days, and the insurer must mail a notice at least 30 days before ending a policy for nonpayment, to the owner and to any designee (Insurance Code §§10113.71, 10113.72). New individual policies come with a free-look period of 10 to 30 days to return the policy for a refund, and at least 30 days for senior buyers.

The rules at a glance

RuleWhat the law requiresSource
Grace periodAt least 60 days from the premium due date, not running concurrently with paid coverage; the policy stays in force during itInsurance Code §10113.71(a)
Lapse noticeMailed at least 30 days before termination for nonpayment, to the owner, any designee and known assignees§10113.71(b)
DesigneeApplicants must be given the right to name at least one other person to receive lapse notices; owners are reminded annually§10113.72
Free look (individual policies)Not less than 10 nor more than 30 days, stated on the cover; nonvariable policies are voided with a full premium refund within 30 days§10127.9
Free look (senior citizens)Not less than 30 days§10127.10

The grace period and lapse-notice rules cover individual and group life policies, except where otherwise provided. The lapse notice rule doesn't apply to non-renewal (§10113.71(b)(2)).

Why this matters

  • A missed payment doesn't end coverage right away. The policy stays in force during the 60-day grace period.
  • A designee is a safety net. If the owner is ill or traveling, a family member gets the warning too.
  • The free look is your chance to review. Read the policy and illustration, and return it within the stated window if it isn't right.

Checklist

  1. Name a designee and update it when your life changes.
  2. Note the free-look deadline printed on your policy cover.
  3. Call the insurer immediately if you get a lapse notice.
