Short answer: Under Miss. Code §83-5-28, a Mississippi homeowners insurer that won't renew your policy must give you written notice at least 45 days before it expires. If you think a notice broke the rules, contact the Mississippi Insurance Department.
The rule
- 45 days' notice of non-renewal, cancellation or reduced coverage for policies issued or renewed on or after July 1, 2026, under HB 1611 (2025). Before then, the rule was 30 days.
- The Insurance Department's Homeowner Policyholder Bill of Rights confirms the 45-day right.
- If the insurer doesn't give proper notice, you can continue coverage at the existing premium in 45-day increments.
- 10 days' notice applies for nonpayment when a creditor loss payee is named.

What to do if you get a notice
- Check the dates. Count from when the notice was mailed or delivered.
- Ask your insurer or agent for the specific reason and whether a repair or update would change its decision.
- Start shopping right away. If regular insurers turn you down, ask about Mississippi's FAIR Plan or other residual market, if one exists.
- If the notice seems late or vague, file a complaint with the Mississippi Insurance Department.
