New Mexico renters insurance and security deposit guide

By Alishahi Insurance, independent broker · CA License #4348151 · Updated October 2026 · En español

Short answer: In New Mexico, renters insurance covers your belongings, liability and loss of use, which your landlord's policy doesn't. Under NMSA §47-8-18 (Uniform Owner-Resident Relations Act), a deposit on a rental agreement shorter than one year can't exceed one month's rent. On an annual agreement, a deposit above one month's rent must earn interest for you. If the owner keeps any part, they must send an itemized list and the balance within 30 days. If they don't, they forfeit the right to withhold any of it.

This guide is general information for New Mexico renters. It isn't legal advice, and local ordinances can add rules. Your lease and policy wording control.

Your landlord's policy covers the building, not your belongings or liability. A renters policy (HO-4) covers personal property, personal liability and loss of use; flood is generally excluded (see FloodSmart). Coverage basics: renters insurance. Roommates: whether renters insurance covers roommates. Liability: how much renters liability coverage you need.

Step 1: Deposit limits

Under NMSA §47-8-18 (as published by the New Mexico Real Estate Commission):

  • On a rental agreement of less than one year, the deposit can't exceed one month's rent.
  • On an annual agreement, if the deposit is more than one month's rent, the owner must pay you annual interest on it.
  • Last month's prepaid rent is treated separately from the damage deposit.

Step 2: The 30-day itemized list

  • No deposit can be kept for normal wear and tear.
  • If there's actual cause to keep any part, the owner must give you an itemized written list of deductions and the balance within 30 days after the rental agreement ends or you leave, whichever is later. Mailing to your last known address counts.
  • If the owner misses that deadline, they forfeit the right to withhold any portion, the right to counterclaim in a suit for the deposit, and the right to sue you separately for damage to the property. They're also liable for your court costs and reasonable attorney's fees.

Step 3: Wildfire, wind and flash floods

Check that your renters policy covers fire, smoke and wind damage to belongings and includes loss of use for evacuations. Flash flooding is generally excluded; see FloodSmart.
