Short answer: After a Governor-declared state of emergency, the California Department of Insurance offers free mediation for disputed residential fire or earthquake claims. To qualify, the claim must be over $7,500 and the amount in dispute over $2,000. The insurer pays for the mediation, and you first go through the CDI complaint process. Disputes over what the policy covers, bad-faith claims and cases already in court aren't eligible.
Who qualifies
According to CDI's mediation program page and Insurance Code §10089.70:
- A residential fire, wildfire or earthquake claim tied to a declared emergency
- A claim over $7,500 with more than $2,000 in dispute
- Not a coverage or legal dispute, a bad-faith claim, or a case in litigation
Steps
- File a complaint with CDI. See how to file a CDI complaint.
- The insurer gets 28 days to resolve it, per §10089.72.
- If it isn't resolved, the case can be referred to mediation.
Cost
Mediation is free to you unless you miss a scheduled session without good cause.
