Short answer: Delaware homeowners near the coast need separate flood insurance and should check wind deductibles. If the standard market won't cover you, Delaware law requires a FAIR Plan, the Insurance Placement Facility of Delaware, which insures the structure and contents but not liability, and often satisfies a mortgage lender. The Delaware Department of Insurance explains that surplus lines can be used once an agent has received three declinations. Insurers must give 30 days' notice before non-renewing.
This guide is general information for Delaware homeowners. It isn't legal advice. Your policy wording controls.
Step 1: Coastal flood and wind
Homeowners insurance doesn't cover flood or storm surge. Quote through FloodSmart. Check for a separate wind or hurricane deductible; see hurricane deductibles explained.
Step 2: The Delaware FAIR Plan
According to the Delaware Department of Insurance's FAIR Plan and surplus lines guide, Delaware statute mandates the FAIR Plan. It provides basic property insurance for your structure and personal contents, but no liability coverage, and in many cases it satisfies a mortgage lender's requirements. Learn more at the Delaware FAIR Plan.
Step 3: Surplus lines
The Department explains that surplus lines coverage is used when coverage can't be procured in the standard market; if your agent has tried the voluntary market and received three declinations, the agent can go to surplus lines. See FAIR Plan vs. surplus lines home insurance.
Step 4: Non-renewal notice
Under 18 Del. C. ch. 41, subch. III, insurers must give notice at least 30 days before the end of the policy period, sent to your last known address. Details: Delaware homeowners non-renewal rules.
Step 5: Claim deadlines
Under 18 Del. Admin. Code 902, insurers must acknowledge a claim within 15 working days and accept or deny within 30 days after proof of loss. More: Delaware insurance claim deadlines.
