West Virginia homeowners insurance guide

By Alishahi Insurance, independent broker · CA License #4348151 · Updated October 2026

Short answer: West Virginia law requires every property policy on a structure in the state to include mine subsidence insurance, at a separately stated premium, unless you waive it in writing. In 15 counties, including Berkeley, Cabell, Jefferson and Wood, it's the reverse: coverage is provided only if you ask for it. The state-backed coverage tops out at $200,000 with a $250 to $500 deductible, and new coverage starts 30 days after you apply. Insurers must give 30 days' notice of non-renewal.

This guide is general information for West Virginia homeowners. It isn't legal advice. Your policy wording controls.

Step 1: Decide on mine subsidence coverage

Under W. Va. Code §33-30-6:

  • Every policy issued or renewed on a structure in West Virginia must include mine subsidence insurance at a separately stated premium unless you waive it.
  • In Berkeley, Cabell, Calhoun, Hampshire, Hardy, Jackson, Jefferson, Monroe, Morgan, Pendleton, Pleasants, Ritchie, Roane, Wirt and Wood counties, no waiver is needed, and coverage is provided only if you request it.
  • New mine subsidence coverage takes effect on the 30th calendar day after the application date.
  • The deductible can't be less than $250 or more than $500, and the insured value reinsured by the state board can't exceed $200,000 or the fire insurance amount on the structure.

Before you waive it, ask your agent about mining history near your home. A standard policy otherwise excludes earth movement.

Step 2: Add flood

Flooding in West Virginia's river valleys isn't covered by homeowners insurance. Quote through FloodSmart.

Step 3: If you can't find coverage

Ask your agent to check admitted and surplus lines insurers. See FAIR Plan vs. surplus lines home insurance.

Step 4: Non-renewal notice

Under W. Va. Code §33-17A-4, insurers must give notice at least 30 days before the policy period ends. Details: West Virginia homeowners non-renewal rules.

Step 5: Claim deadlines

Under W. Va. Code R. §114-14-5 and §114-14-6, insurers must acknowledge a claim within 15 working days, accept or deny within 10 working days after the investigation is complete and pay within 15 working days after a settlement is agreed. More: West Virginia insurance claim deadlines.
